Introduction

Welcome to AniWant. These Terms of Service ("Terms") govern your use of the AniWant website (aniwant.com) and all related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

Please read these Terms carefully, as they contain important information about your legal rights, remedies, and obligations. By using the Service, you agree to these Terms and our Privacy Policy.

1. Acceptance of Terms

By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you agree to these Terms on behalf of that organization and represent that you have the authority to do so.

2. Changes to Terms

We may modify these Terms at any time. If we make changes, we will provide notice by posting the updated Terms on the Service and updating the "Last Updated" date at the top. Your continued use of the Service after the changes have been posted constitutes your acceptance of the revised Terms.

For significant changes, we may provide additional notice, such as sending you an email notification. If you do not agree to the modified Terms, you should discontinue your use of the Service.

3. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that:

  • You will comply with these Terms and all applicable laws
  • If you are under 18, you have obtained parental or guardian consent to use the Service

5. Premium Subscriptions

5.1 Subscription Plans

AniWant offers premium subscription plans that provide enhanced features and benefits. The current subscription options, pricing, and features are described on our Premium page.

5.2 Billing and Renewal

When you purchase a premium subscription, you authorize us to charge the payment method you provide for the subscription fee at the then-current rate. Subscriptions automatically renew for the same subscription period unless you cancel before the renewal date.

5.3 Cancellation

You can cancel your subscription at any time through your account settings. If you cancel, you will continue to have access to premium features until the end of your current billing period, but you will not receive a refund for any unused portion of your subscription.

5.4 Price Changes

We may change the price of subscriptions from time to time. Any price changes will apply to the next billing cycle after the change. We will notify you of any price changes before they take effect.

6. User Content

6.1 Content Ownership

The Service may allow you to submit content, such as preferences, ratings, comments, and feedback ("User Content"). You retain ownership of your User Content, but you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute your User Content in connection with the Service.

6.2 Content Restrictions

You agree not to submit User Content that:

  • Infringes on the intellectual property rights of others
  • Violates any laws or regulations
  • Contains harmful, abusive, offensive, or inappropriate content
  • Contains viruses, malware, or other harmful code
  • Impersonates any person or entity
  • Advertises products or services without our permission

6.3 Content Monitoring

We do not actively monitor User Content, but we reserve the right to review and remove any User Content that violates these Terms or that we find objectionable for any reason, without prior notice.

7. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

  • Using the Service for any illegal purpose or in violation of any laws
  • Attempting to interfere with, compromise, or disrupt the Service
  • Attempting to access accounts, systems, or data you are not authorized to access
  • Scraping, crawling, or using automated methods to access the Service
  • Circumventing or attempting to circumvent any limitations or restrictions on the Service
  • Sharing your account credentials with others or using someone else's account
  • Creating multiple accounts for abusive purposes
  • Engaging in any activity that interferes with or disrupts the Service

8. Intellectual Property

8.1 AniWant Content

The Service and its original content, features, and functionality are owned by AniWant and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

8.2 Third-Party Content

The Service may display content from third parties, including anime data from MyAnimeList through the Tenrai API. This content is the responsibility of the entity that makes it available. We may review third-party content to determine whether it is illegal or violates our policies, and we may remove or refuse to display content that we reasonably believe violates our policies or the law.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT GUARANTEE THAT:

  • THE SERVICE WILL MEET YOUR REQUIREMENTS
  • THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE
  • THE RESULTS FROM THE SERVICE WILL BE ACCURATE OR RELIABLE
  • THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS
  • ANY ERRORS IN THE SERVICE WILL BE CORRECTED

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ANIWANT, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE
  • ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE
  • ANY CONTENT OBTAINED FROM THE SERVICE
  • UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE SERVICE DURING THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.

11. Indemnification

You agree to defend, indemnify, and hold harmless AniWant, its directors, employees, partners, agents, suppliers, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney's fees and costs, arising out of or in any way connected with:

  • Your access to or use of the Service
  • Your violation of these Terms
  • Your violation of any third-party right, including without limitation any intellectual property right, publicity, confidentiality, property, or privacy right
  • Any claim that your User Content caused damage to a third party

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or delete your account through your account settings.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

14. Dispute Resolution

Any dispute arising from or relating to these Terms or the Service will first be resolved through good-faith negotiations. If such negotiations fail, the dispute shall be finally settled by arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules.

15. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and AniWant regarding the Service and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning the subject matter.
